Fairrie Games Terms of Use for Campaign Owners & Prize Sponsors
Effective Date: October 1, 2025

1. Introduction
Fairrie Sdn. Bhd. ("Fairrie," "we," or "us") operates the Fairrie Games ("App"), a marketing and prizes platform designed primarily for Gen-Z gamers. The App enables Merchants, referred to as Campaign Owners and Prize Sponsors, to post their products or services as prizes for
users participating in gaming campaigns.

These Terms of Use ("Terms") govern your access and use of the Fairrie Games as a Campaign Owner or Prize Sponsor. By applying to register and using the App, you agree to be bound by these Terms. If you do not agree, please do not continue with the registration or prize posting process.
2. Definitions
Campaign Owner: A party that organizes and manages campaigns on the Fairrie Games. A campaign may include multiple prize sponsors.
Prize Sponsor: A party that only sponsors prizes but does not organize its own
campaigns.
Campaign: A promotional event created by a Campaign Owner consisting of prizes offered to users.
User: An individual who registers on the Fairrie Games to participate in campaigns and win prizes.
3. Registration and Application
3.1. To use the platform as a Campaign Owner or Prize Sponsor, you must submit a one-time application on Fairrie’s designated platform, providing all required information and
documentation. Fairrie reserves the right to approve or reject any application at its sole discretion.
3.2. Upon approval, you will receive access to post prizes (Prize Sponsors) or create and manage campaigns with prizes (Campaign Owners).
3.3. You must keep your registration and campaign information accurate and up-to-date.

4. Obligations of Campaign Owners and Prize Sponsors
4.1. Campaign Owners must provide the following for each campaign: Campaign Name

Campaign Duration (start and end dates)
Campaign Prizes (detailed descriptions, quantities)
Minimum Spend Value required by users to participate
Minimum Participation Activation (MPA), specifying user activation requirements

4.2. Prize Sponsors shall provide prize details and availability as agreed but shall not create or manage campaigns unless also registered as Campaign Owners.
4.3. You warrant that all prizes offered are legal, genuine, and deliverable according to the campaign terms.
4.4. You shall promptly notify Fairrie of any changes or issues with campaign details or prize availability.
4.5. You shall ensure compliance with all applicable laws, including advertising, consumer protection, and data privacy laws.
5. Data Protection and Privacy
5.1. You agree to comply with all applicable data protection laws, including the Malaysian Personal Data Protection Act 2010 (PDPA).
5.2. You consent to Fairrie collecting, processing, and using your personal information and campaign data for purposes including campaign management, prize administration, marketing communication, and compliance with legal obligations.
5.3. You shall obtain all necessary consents from end-users if you collect or process their personal data through the campaign.
5.4. Fairrie commits to safeguarding your personal data with appropriate technical and organisational security measures to prevent unauthorised access, disclosure, or loss.
5.5. We do not sell your personal data to third parties. Data sharing with trusted third-party service providers and merchants only occurs as necessary for fulfilling campaigns and prize delivery under confidentiality agreements.
5.6. You have the right to access, correct, and request the deletion of your data, subject to legal retention requirements.
5.7. You shall respect user privacy and not misuse collected personal information for unauthorised marketing or other activities.
6. Marketing Commitments
6.1. Fairrie will feature approved Campaign Owners and Prize Sponsors prominently on the App platform, social media, and associated marketing channels.

6.2. Campaign Owners may leverage Fairrie’s marketing assets and collaborate on joint campaigns upon prior written agreement.
6.3. You agree not to conduct misleading or unethical marketing practices in campaigns or prize promotions.
6.4. All marketing materials and campaigns must comply with Fairrie’s content guidelines and Malaysian laws.
6.5. Fairrie reserves the right to remove or refuse marketing content that violates these Terms or legal requirements.
7. Intellectual Property Rights
7.1. You grant Fairrie a worldwide, royalty-free license to use your campaign names, descriptions, and prize details in connection with the App and marketing.
7.2. All other intellectual property rights remain the exclusive property of their respective owners.
7.3. You shall not infringe on the intellectual property rights of third parties in any campaign materials or prize sponsorship.
8. Limitation of Liability
8.1. Fairrie provides the platform "as is" and does not guarantee uninterrupted or error-free service.
8.2. Fairrie is not responsible for any loss arising from issues with campaigns, prize quality, or fulfillment.
8.3. Campaign Owners and Prize Sponsors fully indemnify Fairrie against claims arising from their campaigns or prize offers.
9. Termination
9.1. Fairrie may suspend or terminate your access without notice for breaches, fraudulent activity, or non-compliance.
9.2. Termination requires immediate cessation of all campaign activities on the App.

10. Amendments
Fairrie may amend these Terms at any time with 14 days’ notice via the App or email. Continued use after amendments constitutes acceptance.

11. Governing Law and Dispute Resolution
These Terms are governed by the laws of Malaysia. Disputes shall be resolved exclusively in the Malaysian courts.

By submitting an application and using the Fairrie Games as a Campaign Owner or Prize Sponsor, you acknowledge that you have read, understand, and agree to these Terms.
